A Summary About Personal Injury Law

Personal injury law deals with getting compensation for people who have been injured or fallen ill as a result of someone else?s fault. Legal action for personal injury can be based on a number of different types of law, such as; breach of employers liability to ensure safety in the workplace, breach of occupiers liability to maintain safe premises or breach of contract. Most personal injury claims are based on the law of negligence.

Legally, every person has a duty to take reasonable steps to ensure that people they come into contact with are not injured by their actions, where those actions that are foreseeable could cause harm. The Lord Chief Justice has issued a pre-action protocol on personal injury claims. The pre-action protocol states that the claimant must first send the defendant a letter of claim setting out the circumstances of the accident, detailing the injury, explaining why the defendant is liable and setting out the compensation which the claimant believes they are entitled to. The defendant must be allowed a certain length of time to respond to this letter of claim. The pre-action protocol also sets out what should happen if the defendant wants to instruct a doctor to produce a medical report.

The aim of these procedures is to resolve cases before they come to court by forcing the claimant and defendant to discuss the matter and to try and negotiate appropriate compensation between themselves.

If no agreement on compensation can be reached the claimant will make a claim in either the County Court of the High Court. As long as the claim is worth more than ?5000 it will be dealt with in a formal trial and it will be necessary for both sides to instruct lawyers.

What compensation is awarded in personal injury cases?
The Compensation which is awarded for personal injury varies from case to case. Usually the court will award a sum of money which represents the severity of the injury and the degree of pain and inconvenience which it has caused to the injured party. If the injury means that they are no longer able to do activities which they used to delight in, then they will usually be given additional money to compensate for the hurt to their quality of life and enjoyment.

The court will also award compensation for any financial loss which the claimant has suffered or may suffer in the future. In addition to compensation for time spent off work recovering from the injury, this will include the cost of physiotherapy and transportation to and from hospital, the cost of any special adaptations or mobility equipment, as well as a sum of money to represent the reduction in the claimants ability to earn a living or find a new job in future should this become necessary.

Finally, the court will award compensation for specific items of property which were hurt. For example, a claimant who was injured in a car accident would also be able to claim compensation for their ruined clothes, smashed glasses and hurt phone.

China's Wen vows to fight inflation, confident on growth (Reuters)

DALIAN, China (Reuters) ? China will keep monetary policy tight in order to contain inflation, Premier Wen Jiabao said on Wednesday, but he also signaled caution to avoid hurting the world's second-largest economy.

"We will keep overall price levels basically stable and prevent big swings in economic growth," Wen said in a speech at the World Economic Forum in the northeastern port city of Dalian.

Annual inflation fell to 6.2 percent in August from a three-year high of 6.5 percent in July.

Meanwhile, China will forge ahead with structural reforms and boost domestic consumption to sustain long-term economic growth, Wen said.

He said slowing economic growth was a result of the government's tightening steps and was "within expectations."

Risks in the global economy have not affected China's solid economic fundamentals, Wen added.

"Currently, the global economy is slowly recovering, but instability and uncertainty are growing," he said.

"Unemployment rates in the major economies continues to be high, and emerging economies face rising inflationary pressures," Wen said.

"All this shows that the global economic recovery will take a long time and be arduous and complex."

Some countries face growing sovereign debt risks, and this has sparked turmoil in global financial markets, he said.

China is willing to invest more in European countries, Wen said and called for European countries to recognize China as a market economy.

Wen delivered the opening speech at the event, known as "summer Davos," since the World Economic Forum first began staging the event in China in 2007.

Wen called for the international community to strengthen confidence and enhance cooperation to face the challenges and expressed confidence in the full recovery of the U.S. economy.

Movie Review: Jay and Silent Bob Strike Back ? Unqualified Offerings

You know I love Kevin Smith.? I do.? And I love Jay and Silent Bob.? And Ben Affleck has always done good stuff with Kevin Smith.? But, honestly, Will Ferrell? Jay and Silent Bob Strike Back would have been perfect if they?d left out Will Ferrell.? I mean, how could you go wrong with the concept of America?s two favorite stoners going on a cross-country road trip and meeting up with some hot chicks who want to use them as patsies?? The problem is that in Kevin Smith?s other movies the characters interacting with Jay and Silent Bob have that angsty, quirky Kevin Smith vibe.? This movie is all about slapstick and stunt casting.? Although, I do give props for the light saber battle with Chris Rock as director.? It was like the end of Mallrats turned up to 11.? Ain?t nuthin? wrong with that.

Still, they made up for it at the end.? I cannot think of a more perfect song to end a Jay and Silent Bob movie.

You heard right -- The Big N's own Satoru Iwata just announced that a "Misty Pink" Nintendo 3DS console would be shipping (at least in Japan) on October 20th. Funnily enough, that was just after showing a chart proving that right around half of all DS gamers are ladies. (But Iwata -- what if the dudes dig pink, too?) At any rate, no specific price was mentioned, giving us some level of certainty that no premium will be attached.
