Streaming Gold & Silver Companies Generating Huge Gains for ...

Everyone knows that gold and silver have been on a tear over the past decade, outpacing gains in almost every other sector. Mining stocks have been hit or miss, offering incredible leverage during certain periods and under-performing the metals during other periods. However, one type of precious metals equity has been significantly outperforming both the metals and mining shares. This business model is gold and silver streaming companies.

A streaming company provides financing for precious metal mining companies in the form of a ?gold streaming deal? whereby an upfront cash payment is exchanged for a percentage of gold production from the mine. You can think of them kind of like a bank, but for mining companies.

The streaming company makes an advance payment to a company with a pre-production stage mineral deposit, and in exchange, negotiates a percentage of the metal produced for the life of the mine. The finance model has also been called a volumetric production payment transaction and originated in the oil and gas sector.

The first company to apply this model to the mining industry was?Silver Wheaton(SLW), which remains the largest precious metals streamer today with a market cap of roughly $14 billion.

Buy Gold!

Streaming companies are similar to the more widely-known royalty companies, which secure GSR (Gross Smelter Revenue), NPI (Net Profit Interest), GPR (GROSS PROCEEDS ROYALTY), (NET SMELTER ROYALTY) or some variation. The main difference is that royalty companies are not paid in gold or silver and do not need sustained capital expenditures going forward except the one time upfront payment when an acquisition is made. The best example of a royalty company today is?Royal Gold?(RGLD).

Other companies, such as?Franco-Nevada?(FNV), use a mix of both streaming and royalty deals in their business model. For the purposes of this article, I will focus on streaming companies, as I find their business model more attractive and they have outperformed royalty companies by a wide margin.

Advantages of the Streaming Model

There are considerable advantages of a streaming company including:

1) Diversification?? A streaming company has agreements with multiple miners, thus spreading and mitigating any potential risk. The larger companies have dozens of deals and multiple streams of income.

2) Unlimited Upside Potential?? Since the deals they secure are usually for a percentage of the mine?s production for life, the streaming company stands to benefit immensely if new zones are discovered and actual production comes in higher than originally forecasted. This occurs all of the time in the industry, as drilling delineates new resources, either increasing annual production or vastly extending the life of the mine.

3) Limited Downside Risk?? While a miner may see profit margins squeezed as the cost of production rises, the streaming company typically has a contract for a percentage of the gold/silver production, thus eliminating the issue of rising costs. Royalties are paid out of top-line revenue before any operating expenses are accounted for. In addition, the contracts usually contain a number of provisions protecting the streaming company in the event of fraud, misrepresentation, etc. This is all on top of the considerable due diliegence that is exercised before entering into any streaming deal.

4) Favorable Tax Treatment?? Streamers enjoy a favorable tax situation courtesy of the Canadian Government. As long as they reinvest their proceeds or pay it out as dividends, they are gifted with a tax rate in the neighborhood of 0-8%. That?s a huge advantage when it comes to net profit margin.

So, with all of the upside potential and little of the downside risk with mining, what is not to like? Actually, not much, and this is reflected in the performance of streaming companies versus physical metals or miners.

Case Study of Sandstorm?s Luna Deal

Let?s take a quick look at how a typical deal works, with an example from one of the top-performing streaming companies,?Sandstorm Gold(SAND):

We will focus on one of Sandstorm?s earlier streaming deals with Luna Gold and take a very high level view for simplicity sake. The cost to Sandstorm for the Luna royalty was US$17.8 million in cash and 5.5 million shares of Sandstorm. In return, Sandstorm is entitled to purchase 17% of the life of mine gold produced from Aurizona, at a per ounce price of US$400.

At the time of the deal, Luna?s 43-101 resource estimate on the Aurizona deposit was just over 1 million ounces of gold. If that was the limit of the deposit size, then Sandstorm would purchase, over time, roughly 200,000 ounces at a cash cost of $400 per ounce. This would net Sandstorm $100 million ($900 per ounce gold ? $400 per ounce cost = $500 per ounce X 200,000 ounces). We then deduct the $17 million payment and the cost of the 5.5 million Sandstorm shares at the time of the deal (roughly $0.40 per share) and we can see that Sandstorm stands to pocket over $80 million from an initial investment of $20 million. This equates to a return of around 400%!

Now the really juicy part that highlights the benefits of the streaming model. The Aurizona deposit has since tripled to over 3 million ounces and the price of gold has doubled from $900 to around $1,800 per ounce. So, for Sandstorm?s original investment of about $20 million, they now stand to make roughly $600 million from the deal (original estimate of $100 million x 3 for tripling resource x 2 for doubling gold price). That is a return of nearly 3,000%, all from a single streaming deal!

Sandstorm and other streaming companies get to ride the exploration upside at no additional cost. The risk to Sandstorm is almost entirely confined to the commodity price. And even if the gold price were to drop below the agreed upon purchase price of $400, Sandstorm still gets to buy the gold at the lower of the agreed upon price and the market price, which means a break-even transaction in the event gold goes below $400. Again, streamers benefit from all of the upside potential, yet none (or little) of the risk.

It may seem hard to imagine how this type of deal would be good for Luna Gold or the dozens of other miners inking deals with streaming companies. But when credit markets dry up, this structure is arguably preferable to debt or significant shareholder dilution. After all, nobody is forcing the miners to work with Silver Wheaton or Sandstorm Gold. Their boards have obviously considered the option and decided that working with a streamer is most advantageous for one reason or another.

Sandstorm Resources (now Sandstorm Gold) was founded in 2008, when Nolan Watson and David Awram decided to create a metal streaming company that would be focused on gold acquisitions. Both Watson and Awram were former employees of Silver Wheaton, the first organization to apply this financial model to the mining industry. Let?s take a quick look at how well this model has been performing, both in the short-term and longer-term.

Performance Comparison ? Gold vs. Silver vs. Gold Stocks vs. Streamers

First, I pulled data over the past three months, to capture performance during the current rally. During this time, gold is up 8%, silver is up 17% and the?Market Vectors Gold Miners ETF?(GDX) is up 26%. Those are all impressive gains for such a short time frame, with the S&P500 index up only 4.6%. However, during this same period, the streamers are up more than 10 times the S&P 500, 5 times gold and roughly double the gold miners ETF. Silver Wheaton is up 50% and Sandstorm Gold is up 55% in the past three months alone!

Investing in precious metals

To make sure that we aren?t charting a short-term performance anomaly, I also charted the 4-year percentage returns since the financial crisis. Gold is up 129%, silver is up 236% and the gold miners ETF is up 189%. Spectacular results all around, with gold up more than double the S&P500 and silver up nearly 4 times the market. But again, it was the streamers that blew the doors off, putting in gains of 1,011% for Silver Wheaton and 566% for Sandstorm Gold! Those numbers translate to annual gains that even the most successful hedge funds would drool over.

Parting Shot

The next time an analyst, CNBC talking head or investment ?expert? warns against gold and calls it a ?barborous relic,? you might want to show them these charts. And if you are looking for leverage to the advance in precious metals and don?t yet have a streaming company in your portfolio, hopefully this article provides some insight and inspiration.

In my estimation, both the gold and silver price have much higher to go before reaching a top. John Williams of ShadowStats has?calculated the true inflation-adjusted high for gold at $8,890 and for silver at $517. This is assuming a return to 1980 pricing, but the conditions that caused that spike are much more severe today. So, I think there is a good chance of those targets, despite seeming lofty today, being easily surpassed.

$8,890 gold and $517 silver represent upside of more than 400% for gold and 1,500% for silver. Given the type of leverage we have seen from the streaming companies and select mining stocks, the potential gains are truly astronomic. With governments worldwide embracing quantitative easing, central banks buying huge quantities of gold, and investment demand for silver rocketing higher, precious metals remain one of the best investments of our time.

Yesterday, KTVN Channel 2?s John Potter aired a report on decreasing foreclosure rates in Reno-Sparks. In case you missed it, you can catch John?s report, Nevada, Washoe County Foreclosure Rates Tumble, in the video below?

In preparing for his report John Potter contacted me to provide some market data and commentary. While compiling the numbers for the story I found an interesting trend that I thought I?d share with the blog. Specifically, the relationship between the number of bank-owned properties (REOs) sold and median sales price. Namely, the higher proportion of REOs sold in a given month, the lower that month?s median sales price.

Now, perhaps many readers will view this observation as nothing novel or noteworthy, but when I pulled the numbers I was surprised with just how striking the relationship was. Check out the year-to-date numbers in the table below?

And if you really would like some fun, use your analysis to predict what October?s median sales price will be based on the percentage of bank-owned properties sold. At the moment, less than ten percent (9.8% to be precise) of houses sold in October have been REOs. Assuming that percentage holds for the entire month, what will be October?s median sales price?

Amid ongoing economic crisis, EU celebrates 'Single Market Week'

The EU is celebrating the 20th anniversary of the single market this week, in part to point out that despite the economic crisis wracking Europe, the union has brought positive changes too.

News reports about the European Union nowadays do not give much reason for celebration. Greece is on the brink of economic collapse, other European countries are also in severe economic troubles, and shrinking solidarity is going hand-in-hand with reviving stereotypes. Yes, the European Union won the Nobel Peace Prize last week, but this news was quickly met with cynical comments.

Nevertheless, the EU today kicked off a week of celebrations, commemorating the 20th anniversary of the single market, which allows Europeans and their goods to move around all 27 member states without borders or barriers. The Single Market Week encompasses events all around Europe, with various ?opportunities to discuss the main achievements of the Single Market.? Some of these include ?cheaper calls abroad,? ?safer toys,? and ?more rights for travelers,? according to documents handed out to attendees of the launch event of the Single Market Week at the European Parliament in Brussels.

The celebration comes at a time when citizens' trust in the European Union is at an all-time low, according to the most recent survey by Eurobarometer. Only 31 percent of EU citizens say they trust the European Union (mind you: they trust their national governments even less). Also, 28 percent have a flat-out negative view of the EU ? almost double the figure of six years ago.

According to some of the speakers today, the European Union doesn't always receive the credit it deserves. ?Citizens don't attribute their cheaper mobile phone bills to the single market,? said Malcolm Harbour, a member of the European Parliament for the British Conservative party, during a meeting with journalists. ?Sometimes we forget how much has been achieved. The free movement of people, students studying abroad ? citizens take that for granted.?

Mr. Harbour has a point. I arrived here in Brussels yesterday from the Netherlands, without realizing that my train didn't have to stop at the border. The only reason I brought my passport was to show it at the security check of the European Parliament. And it is not just free movement of journalists and other Europeans. If I want, I can buy as many Belgian waffles as I want without having to declare them at the border.

As European Commissioner Michel Barnier said: ?Our lives have been made easier.? But as with most advancements, we quickly take them for granted. So how to make the people more aware of these things? Mr. Barnier's answer was simple: ?We have to talk about it.? And that's what EU representatives will be doing this week.

Georges St-Pierre agrees with ?boring? criticism

Heading into his UFC 154 bout with Carlos Condit, UFC welterweight champion Georges St-Pierre is riding a nine-fight win streak. Dating back to UFC 69, when he lost the belt to Matt Serra, GSP has not lost. However, his last win by a stoppage was in January of 2009, when he TKOed B.J. Penn. Since then, he won five-round decisions over Thiago Alves, Dan Hardy, Josh Koscheck and Jake Shields.

The run of decisions has brought about criticism from fans who call the longtime champ "boring." As he has rehabbed from a knee injury over the past year, GSP has heard the criticism, and guess what? He agrees.

"I agree with the criticism," St-Pierre told The New York Post. "I want to do better. I want to give more entertainment to the fans."

CSU East Bay students had their sneakers tied tight in anticipation for the opening of intramural sports Monday night, as it opened under new management and with new goals for this year.

The Recreation and Wellness Center will host five sporting leagues in hopes of promoting student activity, friendly competition and skills development for CSUEB students.

Co-ed volleyball and basketball will be offered, as well as competitive leagues for both sports.

Newly appointed sports and activities coordinator, Corey Gazay, said he expects to unfold a memorable year of intramural sports.

?I definitely have high expectations,? said Gazay. ?I want to build excitement on campus and have intramural sports [be] the thing to do on weekdays.?

Gazay, a former graduate assistant for Competitive Sports at the University of Florida hasn?t wasted a moment since being hired.

Gazay has already implemented new ?3 vs. 3? leagues for both basketball and volleyball, with volleyball being the only one available for the fall quarter.

?The new 3 vs. 3 leagues cater to students who do not have anything going on in the afternoon,? Gazay explains. ?It allows students who have a long day of classes to break up hours of studying and play the sport they love.?

Gazay is focused on promoting a simple sign-up-and-register process for students who are eager to participate.

?The only thing a student needs to do is have a membership to the RAW and post a five dollar team fee to play,? Gazay said. ?If the student does not sign up the first week of the quarter, it is never too late for them to contact me to be placed on a team.?

Gazay?s focus on a simple registration process for intramural sports accommodates students like Omarr Mclean, a junior kinesiology major who said he can?t wait to get back on the hardwood and play basketball with his team ?Cash Money.?

?Basketball for intramurals gives us students something to look forward to while on campus,? says McLean.

McLean, a second year participant of intramural basketball, commends the Recreation and Wellness Center for providing leagues available for students.

?Intramural basketball has taught me how to have an appreciation for the sports we have offered to us on campus,? he explained.

From one court to the next, Rachel Alvarez, a kinesiology major, retreats to the volleyball court for some peace and relinquishment from the everyday stresses of classes.

?It helps me stay relaxed and get somewhat of a work out in regardless of the sport,? says Alvarez. ?Mentally, it allows students to get a break from schoolwork.?

Alvarez credits the league for bringing students together for friendly competition, giving them an opportunity that would not be afforded anywhere else.

?I am looking forward to the competitive aspect of volleyball,? says Alvarez. ?But playing with my friends on the same team takes off that competitive edge and makes it more fun.?

The volleyball leagues offered have brought in a crowd very pleased and Associated Students Inc. (ASI) President Jerry Chang is even participating with some of his fellow ASI delegates.

The experiences of Mclean and Alvarez complement Gazay?s vision and commitment to providing a memorable sporting experience for all students. This speaks to the future direction of intramural sports and its goal of keeping students seeking more competitions.

?After students play, I want them to ask me ?Whens the next game??? explains Gazay. ?Once people come to the games and see what it?s about, we have them hooked.?

Miesha Tate pushes for Zoila Gurgel to get better Bellator billing

Former Strikeforce bantamweight champion Miesha Tate is not afraid to speak her mind. Last week, she caused a stir when she said there are circumstances where it's acceptable for a man to hit a woman. This week, she's speaking up on behalf of Bellator flyweight champion Zoila Gurgel.

Despite holding a belt and fighting near her hometown, Bellator has placed Gurgel's non-title bout with Casey Noland on the untelevised undercard. For good reason, Tate was annoyed by this and tweeted Bellator president Bjorn Rebney.

Tate sent several more tweets like these and encouraged her followers to tweet Bellator and Bjorn Rebney until they put Gurgel on the main card. Rebney explained his reasoning to MMA Fighting.

"Zoila's been plagued by injury after injury over the last 19 months, having not fought since March, 2011," he wrote. "We felt that the best road back for her did not include rushing her into a major fight against one of the top-ranked women in the world. This is not a world title fight as it's made significantly north of the 115 weight limit where she holds our title. Depending on how Zoila feels and performs on Friday, we can then determine the next appropriate step back."

But that doesn't explain why a champion isn't on television. Brian Rogers is not in a "world title fight," nor is he part of the Bellator tournament bouts that will be aired, but he's on the televised card. When fellow champions Michael Chandler and Ben Askren fought non-title bouts, their fights were on the main card.

When Tate spoke on men hitting women who hit them first, she was railing against a double standard. It looks like she's still fighting one this week.

Family member arrested in Calif. triple slaying - KWQC-TV6 News ...

RANCHO CORDOVA, Calif. (AP) - A 19-year-old man accused of killing his sister-in-law and her two small children in an attack that stunned authorities for its brutality had a strained relationship with his family, police in Northern California said Wednesday.

"Something bad was brewing" between Grigoriy Bukhantsov and his relatives before the slayings Tuesday in Rancho Cordova, Sacramento County sheriff's Sgt. Jason Ramos said.

Authorities had not indicated exactly what they think prompted the attack.

Bukhantsov was picked up at a Denny's restaurant hours after midnight Wednesday. He had fallen asleep in a booth in front of a plate of chicken-fried steak with gravy, where police said they found him after locating a minivan that had been stolen from the home in the Sacramento suburb.

He was booked into the Sacramento County Jail without bail. Ramos said he was the only suspect. The father, who discovered the scene, is not a suspect. He was distraught and has been cooperating with authorities, police said.

Bukhantsov had been hopping between the homes of various relatives and "just didn't have a good relationship with family members, and there have been suggestions that something bad was brewing for some time," Ramos said.

Ramos said Bukhantsov's drifting may have included possibly the tidy duplex in the Sacramento suburb where his brother's family lived.

"But I don't think anybody, obviously, could have foreseen an act like this," he added.

Ramos said the victims suffered extensive trauma, likely after a "violent encounter."

He said the manner of the attack was a stabling, slashing or slicing, but he declined to say what kind of weapon was used or go into further detail pending a coroner's report. Authorities also have not identified the victims.

Ramos said the attack was "shocking, even to veteran law enforcement."

The crime has rocked a large community of Slavic immigrants who came to the area in the 1990s after the breakup of the Soviet Union.

The slain mother and her husband were members of the Bethany Slavic Missionary Church, a 6,000-member evangelical Pentecostal denomination on the outskirts of Sacramento that was founded by "immigrants from the former Soviet Union," according to the church's website.

The mother, identified by church secretary Valentina Bondaruk as Alina, had been baptized at the church and grew up attending Sunday school there. Bondaruk said the woman taught Sunday school at one point and regularly helped out during church functions.

They were "a very good family and very good Christians," Bondaruk said.

She identified the slain children as 3-year-old Emmanuela, 2-year-old Avenir. Another child, 6-month-old Mark, survived the attack and is with family, police said.

All the names were chosen from the Bible, Bondaruk said.

The children's father, Denis Bukhantsov, arrived home Tuesday afternoon and found the grisly scene, Ramos said.

There were signs of trouble a day before the slayings, said neighbor Alex Oropesa.

"They did have a family issue the day before," Oropesa said. "I just know that they had a lot of people over the day before dealing with issues."

Oropesa said she could not say exactly what the problems were because the family was speaking Ukrainian, which she can't understand.

She said there appeared to be only "a little bit of arguing."

On the day of the slayings, Oropesa said she heard some tires screech, but otherwise nothing seemed out of the ordinary.

The killing also had parallels to another tragic slaying in Sacramento County's Ukrainian community. Nikolay Soltys was charged with killing his pregnant wife, his 3-year-old son and four other relatives in Rancho Cordova in 2001. He was captured after a nationwide manhunt and later hanged himself in jail while awaiting trial.

There are more than 100,000 members of the Russian-speaking community in the Sacramento area, said David Ponomar, who owns the Sacramento-based Afisha Media Group, which includes a Russian-language newspaper, magazine, radio programs and TV programs.

Maria Murguia, who lives next door to the home where the slayings occurred, said she didn't know the family well, but would often say hello to them, especially when she saw the children playing in the backyard. She said she never heard any yelling or fighting coming from the home.

"They were a normal family. I heard the babies playing in the backyard and saw their mother giving them food sometimes. I never see anything," she said. "I don't know what happened, and I'm so sad because those are little kids."

The flame-retardant mixture known as "Firemaster 550" is an endocrine disruptor that causes extreme weight gain, early onset of puberty and cardiovascular health effects in lab animals, according to a new study spearheaded by researchers from North Carolina State University and Duke University.

Firemaster 550 is made up of four principal component chemicals and is used in polyurethane foam in a wide variety of products, ranging from mattresses to infant nursing pillows. The flame-retardant mixture was developed by Chemtura Corp., and was first identified by the research community in 2008. It was developed to replace a class of fire retardants being phased out of use because of concerns regarding their safety. This new study represents the first public data on whether Firemaster 550 has potential health effects.

In this pilot study, pregnant lab rats were assigned to three groups: a control group, which was not exposed to Firemaster 550; a "low-dose" group, which ingested 100 micrograms of Firemaster 550 once per day throughout pregnancy and nursing; and a "high-dose" group, which ingested 1,000 micrograms on the same schedule. These environmentally relevant doses are lower than the doses used in industry-funded studies. Researchers then evaluated the physiological outcomes of the exposure in both the mothers (called dams) and the offspring (called pups).

Importantly, the researchers detected TBB, one of Firemaster 550's component chemicals, in the fat of all the exposed dams and offspring, but none of the unexposed animals. This means the flame retardant is capable of crossing the placenta during pregnancy, reaching infants via breast milk, or both.

Because flame retardants that have been phased out are known to disrupt thyroid function, and Firemaster 550 includes chemicals with structural similarities, the researchers looked at circulating thyroid hormone levels in dams at the end of the nursing period. The high-dose dams had much higher thyroid hormone levels than the control group, while low-dose dams had marginally higher thyroid hormone levels. This is significant because thyroid hormones influence brain development during pregnancy, as well as a host of other biological functions, such as metabolism.

Researchers also found extremely rapid weight gain in the offspring. By the time they were weaned from nursing, high-dose male pups were 60 percent heavier than the control group and high-dose female pups were 31 percent heavier than the control group.

The increased weight in female pups contributed to the early onset of puberty. The control group hit puberty at 33 days old, while the high-dose group hit puberty at 29 days.

High-dose female pups also had difficulty regulating their glucose levels as adults. High-dose males had thickened walls in the left ventricle of the heart, suggestive of cardiovascular disease.

"This study indicates that Firemaster 550 is an endocrine disruptor, and that raises a lot of important questions," says Dr. Heather Patisaul, an assistant professor of biology at NC State and lead author of a paper describing the work. "This was a small-scale study. We need to continue this work with a larger sample size and look at a broader range of potential effects related to obesity, thyroid hormone function and metabolic syndrome. We also want to determine which of the component chemicals in Firemaster 550 are responsible for the various effects."

    Debt collectors' tough tactics under scrutiny by feds

    The Consumer Financial Protection Bureau announces new procedures for fixing credit report errors. NBC's Danielle Leigh reports.

    The figure is staggering: Approximately 30 million Americans have a debt subject to collection. Many of these people insist they do not owe the debt attributed to them. Complaints about debt collectors are legion ? from abusive tactics to outright fraud.?

    The Consumer Financial Protection Bureau published a rule on Wednesday that will give the agency the power (starting Jan. 2) to supervise the larger consumer debt collectors. The agency says this is the first time there will be such supervision at the federal level.?

    ?We're going to do everything we can to see that people are treated fairly,? said CFPB director Richard Cordray.?

    Cordray sat down with me for a one-on-one interview just before a public hearing in Seattle on Wednesday. The CFPB was gathering feedback on its debt collector oversight proposal.? Here are the highlights of our conversation.

    Q: It seems like sending people to collection is now the ultimate threat to get someone to pay ? whether they really owe the money or not.? Companies threaten to send the consumer to collections and ruin their credit score. And all too often people pay because of that. Is there anything that can be done about this?

    A: That's why we are both continuing our efforts to enforce the law on debt collectors and now entering into the field of close examination and supervision of debt collectors.?

    The intersection between debt collection and credit reporting has become a new phenomenon because it gives much more leverage to debt collectors. One of the things debt collectors understand very well is leverage. The fact that you can owe a hundred or $200 debt, but in your credit report that might affect whether you can get a $100,000 or $150,000 mortgage, is tremendous leverage for collection.?

    We need to be thinking carefully about how these changes in the market are affecting consumers, taking certain problems that existed before and magnified them into much greater problems of more harm to consumers, and utilize that analysis as we go about fixing these markets.?

    Q: You now regulate credit-reporting agencies ? an area that people and consumer advocates have been complaining about for years and years. What are the problems in this area and what changes would you like to see?

    A: We see several problems. A major problem that consumers complain about a lot is accuracy of information. We know this is a problem, in part because of the way information comes in to the credit-reporting agencies from furnishers, some of whom are more reliable than others.?

    Also the handling and processing of the huge volume of information the big three credit-reporting companies take in on hundreds of millions of Americans is fraught with concerns about being able to manage that effectively and accurately.?

    The difficulty that consumers often seem to have in disputing inaccuracies and getting them resolved and corrected is a big concern for us. The credit-reporting function now casts an enormous influence over the lives of most Americans, many of whom don't realize it, and yet they're very dramatically affected every time they go out to seek a loan. Whether they get a loan or whether they get it at a higher interest rate is dominated by how their credit report looks.?

    Q: You are now taking complaints about credit-reporting agencies and you propose to do the same with debt collectors. Are you simply gathering information or will you actually try to help individual consumers who have a problem?

    A: We do both. There are greater legal protections for the individual if they begin with the credit-reporting company before coming to us. But we now are taking complaints about credit-reporting companies. So if people are not satisfied with the resolution, as many people tell us they're not, we now will be handling those complaints.?

    I think this, in and of itself, will affect the way complaints are handled by the companies. But we will now be in a position to follow up and seek appropriate resolutions.?

    Q: ?Because of recent enforcement actions by your agency, American Express, Discover and Capital One will return $425 million to nearly 6 million of their credit card customers for a wide range of actions that alleged violated consumer protection laws. These were huge settlements. Do you think they will change the way financial companies do business going forward and how they see the enforcement power of the CFPB?

    A:?I know it will and it's already changing. That's a start but there's more to come in that area because the deceptive marketing practices on credit card service add-ons were widespread within the industry.

    Not only is it affecting the way those products are marketed or whether they're going to be marketed, but I think it's causing people to rethink how they're marketing other products as well. I do think our early actions are being scrutinized very carefully by the industry, that they're taking signals from them... and applying them to their business model.?

    Q: ?Are you trying to make the fines and refunds so big that companies?won't? consider this an acceptable cost of doing business?

    A:?We do see part of the objective here to make it easier and more advantageous to follow the law, rather than get an advantage from breaking the law.?

    We're trying very hard to think strategically about these markets. It's always satisfying to take down a bad actor and to stop them from doing what they're doing. But if there are many more popping up to take their place, as is true in some of the financial markets, you don't necessarily accomplish what you'd hoped to accomplish.?

    When they (companies) come to understand that the right way to do business and the cost effective way to do business is to follow the law, then we'll be succeeding.?

    Q: ?Your goal has been to bring fairness and transparency to the financial marketplace, to level the playing field. Do you feel that you?ve done that? Is it still an uphill battle?

    A:?Before the consumer bureau, it was a very bumpy playing field for consumers. There was a lot to trip over, and much of it was put in their way deliberately, or at least with deliberate indifference.?

    I think that is changing, but it's going to take some time to smooth that out. And the work that we are doing, we're encouraged that it is making a difference and it has the capacity to make more of a difference.?

    Many firms across different industries...want to comply with the law, want to avoid problems. And as we can signal clearly what we understand those problems to be, I do think they're going to be attentive in many cases to fixing them.?

    Q: There are members of Congress who still believe the CFPB was a mistake and they?d like to see your enforcement powers limited. What do you say to them?

    A:?We're working hard every day to convince them to the contrary, and I think we're making a lot of progress.

    San Francisco to train 2,500 for tech jobs

    San Francisco Mayor Ed Lee launched a federally funded program to train and place 2,500 residents of diverse ages and backgrounds in jobs in the city's burgeoning tech sector over the next five years.

    The TechSF, which will use $8 million in workforce training grants from the U.S. Department of Labor, is a partnership with San Francisco Citizens for Innovation & Technology (SF.CITI), a new coalition of more than 330 of the city's high tech companies, as well as with local community colleges and educational institutions, workforce training nonprofit organizations.

    SF.CITI Chairman Ron Conway said that Jawbone, a maker of wireless consumer devices like headphones and speakers, will be taking a leadership role in the effort.

    The first class of the TechSF Academy has 80 students taking courses in mobile app development, networking, multimedia design and tech support. Training partners include the Bay Area Video Coalition, Bayview Hunter?s Point Center for Arts & Technology, City College of San Francisco, San Francisco State University and Year Up Bay Area.

    SF.CITI members, which collectively employ 20,000 people, has been gathering data to understand the hiring needs of its member companies to help local educational institutions train local residents to fill those jobs.
